X3 Background ("the Service") is operated by X3 Fleet Safety LLC ("X3," "we," "us"). The Service helps motor carriers screen driver applicants — PSP, MVR, CDL verification, criminal, and Drug & Alcohol Clearinghouse — and assembles an audit-ready 49 CFR 391 driver-qualification file.
Screening reports are consumer reports obtained through a credentialed consumer reporting agency (CRA). The candidate's standalone FCRA disclosure and written authorization are captured and held by the CRA before any report is run. As the employer, you certify your permissible purpose. X3 operates the workflow as your service provider; it is not the CRA.
If you take adverse action (declining to hire, removing from duty) based on a report, the FCRA pre- and post-adverse-action obligations are yours. X3 provides the workflow, notices, and copies; the decision and its legal consequences remain yours. Nothing here is legal advice.
Per-screening packages and monitoring add-ons are billed as described at purchase. Report and government fees vary and are passed through at cost. Fees already incurred are non-refundable.
Report content, availability, and timing are controlled by the CRA and source agencies. We do not guarantee any report is complete, current, or error-free, or that a candidate is or is not qualified.
To the maximum extent permitted by law, X3's total liability arising from the Service is limited to the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including hiring outcomes or claims arising from your employment decisions.
